Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and QDev governing your use of the QDev browser extension, the QDev website (www.qdev.app), and the optional hosted AI service (together, the “Service”). By installing the extension, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

01Who we are

QDev (“QDev”, “we”, “us”) is operated by Ben Watson as an individual sole operator; there is no separate legal entity. You can reach us at hello@qdev.app. How we handle personal data is described in our Privacy Policy, which is incorporated into these Terms.

02The Service

The QDev extension is a local-first viewer for JSON, YAML, and TOON. Its core features — opening files, the tree and graph views, search, schema inference, and running jq — operate entirely in your browser and require no account. The hosted AI service is an optional, paid feature that turns a natural-language question into a jq query, which then runs locally against your data. On-device AI options run without any network access.

03Licence to use the extension

The extension's source code is made available under the PolyForm Noncommercial License 1.0.0, which permits use for any noncommercial purpose. Your use of the code is governed by that licence; these Terms govern your use of the hosted Service and website. Where the licence and these Terms address different things, both apply; where they genuinely conflict as to the code, the licence controls.

04Accounts

A QDev account is required only for the hosted tier. Authentication is provided by Clerk. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. You must be old enough to form a binding contract in your jurisdiction (and at least 16). Notify us promptly of any unauthorized use.

05Subscriptions, billing, and refunds

• Plans. The hosted AI tier is offered as a paid subscription. Current pricing is shown at checkout and on our pricing page.
• Payment. Payments are processed by Stripe through Clerk Billing. We do not receive or store full card details.
• Renewal. Subscriptions renew automatically for successive periods until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you retain access until then.
• Price changes. We may change prices; changes apply to the next billing period after reasonable notice.
• Refunds. Except where required by law, payments are non-refundable and partial periods are not pro-rated. Consumers in the EEA/UK may have a statutory right of withdrawal; by starting to use the hosted Service within any applicable withdrawal period, you request immediate performance and acknowledge that right may no longer apply once the Service is fully performed.
• Taxes. Prices may exclude applicable taxes, which you are responsible for.

06Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms or the licence;
• use the Service commercially in a way the extension licence does not permit, or resell, sublicense, or provide the hosted Service to third parties;
• abuse, overload, or circumvent the hosted service's rate limits, quotas, or access controls, or share, resell, or misuse your entitlement token;
• attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe or test their vulnerability without our written permission;
• submit content you have no right to submit, or use the Service to process content that is illegal or infringes others' rights.

07The hosted AI feature

The hosted feature generates a jq query from your question using a third-party model. AI output can be wrong, incomplete, or unexpected. You are responsible for reviewing any generated query before relying on it and for the results of running it against your data. The feature is provided to assist, not to replace your own judgement, and we make no guarantee as to the correctness or fitness of any generated query. What the hosted feature sends and does not send is described in the Privacy Policy.

08Intellectual property

The QDev name, logo, and branding are ours; nothing in these Terms grants you a right to use them except to identify the product. Rights in the code are governed by the licence in section 03. Your data is yours — we claim no ownership of the documents you view or the questions you ask, and we do not use your content to train AI models.

09Third-party services

The Service relies on third-party providers, including OpenAI (model inference), Clerk (accounts), Stripe (payments), and Railway (hosting). Your use of the Service may also be subject to their terms, and we are not responsible for third-party services. See our Privacy Policy for the role each plays.

10Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any AI output will be accurate. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for consumers.

11Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim, or fifty US dollars (USD 50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12Indemnity

You agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the Service or your breach of these Terms, except to the extent caused by us. This section does not apply to the extent prohibited by applicable consumer law.

13Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, to protect the Service or other users, or as required by law. On termination, your right to use the hosted Service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.

14Changes

We may modify the Service or these Terms. For material changes to these Terms we will update the “last updated” date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.

15Governing law

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws rules, and the courts of Germany will have jurisdiction, except where mandatory local law (including consumer-protection law in your country of residence) provides otherwise.
